Terms of Service

1. Parties

These Terms of Service ("Terms") govern the relationship between Daniel Navarro Murillo, NIF 25483525P, Calle Mayor 57, 50500 Tarazona, Zaragoza, Spain ("SoloSearch", "we", "us") and any individual or legal entity that registers an account and uses the SoloSearch service ("Customer", "you").

By creating an account you confirm that you have read, understood, and accepted these Terms in full.

2. The service

SoloSearch provides a hosted product search platform, including an administration panel, a search API, and an embeddable widget (collectively, the "Service"). The features available to you depend on the plan you have subscribed to.

We reserve the right to modify, improve, or discontinue features of the Service at any time. We will make reasonable efforts to communicate significant changes in advance.

3. Account registration

You must provide accurate and complete information when creating your account and keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

Accounts are personal and non-transferable unless we expressly agree otherwise in writing.

4. Subscriptions and payment

Access to the Service requires a paid subscription. All subscriptions begin with a 30-day free trial. Your payment method is saved at registration but is not charged until the trial ends.

Payments are processed by Paddle.com Market Limited, which acts as Merchant of Record. Subscription fees are charged on a recurring monthly basis on the same date as the original purchase. Prices are shown inclusive of applicable taxes.

If a payment fails, we will retry it and notify you by email. Access to the Service may be suspended if payment remains outstanding after reasonable notice.

5. Cancellation

You may cancel your subscription at any time from the billing section of your account. Cancellation takes effect at the end of the current billing period — you retain full access to the Service until that date. No partial refunds are issued for unused time.

We may cancel or suspend your account immediately if you breach these Terms.

6. Refunds

We do not offer refunds except in the following circumstance: if a billing error on our part results in an incorrect charge, we will refund the difference promptly upon verification. All refund requests must be submitted to hola@solosearch.app within 30 days of the charge.

7. Price changes

We may change subscription prices from time to time. Any price increase will be communicated to active subscribers by email at least 90 days before taking effect. The new price will apply at your next renewal following the effective date. If you do not wish to continue at the new price, you may cancel your subscription before the effective date without penalty.

8. Acceptable use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service to index, distribute, or promote illegal, fraudulent, or harmful content.
• Attempt to gain unauthorised access to any part of the Service, its infrastructure, or other customers' data.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service.
• Use automated means to scrape, crawl, or excessively query the search API beyond normal operational use.
• Resell, sublicense, or otherwise make the Service available to third parties without our prior written consent.
• Use the Service in a way that degrades its performance or availability for other customers.

We reserve the right to suspend or terminate accounts that violate these restrictions without prior notice.

9. Customer data

You retain full ownership of the product data and content you upload or connect to the Service ("Customer Data"). By using the Service you grant us a limited licence to process Customer Data solely for the purpose of providing the Service.

We do not sell, share, or transfer Customer Data to any third party under any circumstances. Customer Data is only disclosed when required by law or by a binding order from a competent authority.

Upon account termination, Customer Data will be deleted within 30 days, except where retention is required by law.

10. Intellectual property

The Service, including its software, design, trademarks, and documentation, is the exclusive property of SoloSearch. Nothing in these Terms transfers any intellectual property rights to you. You may not use our name, logo, or trademarks without prior written permission.

11. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted availability. We do not guarantee that the Service will be error-free or that defects will be corrected within any specific timeframe.

12. Limitation of liability

To the maximum extent permitted by applicable law, SoloSearch's total cumulative liability to you for any claims arising out of or related to the Service — whether in contract, tort, or otherwise — shall not exceed the total fees paid by you to SoloSearch in the twelve (12) months immediately preceding the event giving rise to the claim.

In no event shall SoloSearch be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of data, or loss of business opportunity, even if advised of the possibility of such damages.

13. Indemnification

You agree to indemnify and hold harmless SoloSearch from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your Customer Data, or your violation of these Terms.

14. Modifications to these Terms

We may update these Terms from time to time. When we do, we will update the date at the top of this page and notify active subscribers by email at least 30 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

15. Governing law and jurisdiction

These Terms are governed by the laws of Spain. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Zaragoza, Spain.

If you are a consumer resident in the European Union, you may also have the right to bring proceedings before the courts of your country of residence.
